Open in New Tab shouldn't clone the current tab's state. That's the Clone Tab's job. Open in New Tab should just open the path in a new fresh tab.
Edit.More details:
It happens when you already have the same path open in another tab and have changed it's "fresh state" by resorting another way or something like that. And when you try to open the same path with "Open in New Tab", the new tab inherits the state of the tab on which you've changed it's default state.
