I have mp4 extension unticked in audio files previewed formats however, if I search for audio files it appears in the results.
taking into consideration the power filter won't match it as audio file.

? What exactly has the preview todo with generic file type exclusions?

Any extensions excluded from Preview in Configuration | Previewed Formats are nevertheless used by the find files type filter

according to the help file nothing but why excluding extension affects power visual filters but not find files.
in Visual filter and filnd files you use {:Audio} so what's the difference

What about showing your filter definition?^^
