Hmm, not sure. Some users may be colour-blind, so they would not see "in your face" orange bar as obviously as others would. Also, having greyscaled your screenshot, I note that colours of the background caption text do not contrast very well, thus spoiling readability.
Colors will be configurable.

I mean: if i set an filter this is shown and if i remove the filter this bar vanish too.
Which would be not good i think 'cus the high of the list would in- and decrease always.
2.) what whit dual panel?
I mean: will there be the same but empty filter bar on the other pane too?
3.) the Visual Filter name could be mentioned in that bar too (in the tab this is often cut off)
4.) will it be that this bar could be abused to show user own messages via scripting?
(status msg is e.g. overwritten by back ground process messages, so this would be an alternative)

Also, with reference to your screenshot, are the 2 items that we can't see really
hidden or they are
filtered out? Will it have a context menu to remove such a filter? If yes, the caption should be improved to inform of a way to remove a filter instead of saying how many items are not shown.

Ok, but I think showing the VF name and value/details would be
much more useful than the generic text of "The list is filtered: A VF is applied" esp if they have tabs not showing or tabs are too small to show the VF...then user would be able to tell why his TXT files aren't showing cause his VF excludes them...using the generic text, he'd not have that info readily avail.
And about placement: After seeing what others said, I'd suggest putting it at bottom of list instead of top, and thus be seen near the SB if that shows or be a sorta-substitute for it if not.
That would also help with the issue of height/size jumps as seeing the col headers move up/down would seem to be more distracting than loss/gain of one list item at bottom.
