I think I know what's going on here and why this anomaly exists. What's happening is you are trying to turn LMB into a defective version of RMB w/o a menu by synchronizing their selection patterns while forgetting why such a weird pattern for RMB exists in the first place. It's broken here too in ::fresh; w/o any change in settings. Also, if I re-press Ctrl (Ctrl Up, Ctrl Down) before every next click, it works correctly but if I hold Ctrl, it gets bugged after a couple of clicks and starts skipping some items.

Well it should either preserve all 3 or none, also something weird with Ctrl going on, not always working.
PS It doesn't work the way you're describing, it shall drop the selection and re-select what you're clicking on instead.

Almost there, you forgot refocusing from the Address Bar and from the Tree. Same stuff, it preserves the selection in 2 out of 3 cases (white space and selected items) but loses it when clicking on unselected ones.

You still have at least 3 ways to close the menu but keep everything selected:
1) press Esc - works in many other situations when you change you mind
2) hold Ctrl (or Shift) and clik on white space
3) click on Window Title Bar / Breadcrumb Bar / Tab Bar / Status Bar / ...

Both solutions have pros and cons, the current one, for instance, allows to get both single click and double click actions w/o any delay (by undoing on double-click what was done on single click and then performing the double-click action).
